A patent is a set of exclusive rights granted by Indian government to an inventor or their assignee for a limited period of time in exchange for a public disclosure of an invention. The procedure for granting patents, the needs placed on the patentee and the extent of the exclusive rights according to Indian laws. Normally, however, a patent application must include one or more claims defining the invention which must be new, non-obvious and useful. The application of patent is required to be filed according to the territorial limits where the applicant in case of joint applicants, for a patent normally resides or has a place of business or the place from where the invention in reality originated. If the applicant for the patent having no business place or domicile in India, the suitable office will be according to the address for service in India given by the applicant or party in a proceeding. The appropriate office once decided in appreciate of any proceedings under the Act shall not normally be changed.
